How does Uber's insurance coverage work if I am injured as a passenger?

Uber drivers are required to carry their own personal auto insurance, but Uber also provides coverage when a driver is active on the app. If you are a passenger in an Uber when an accident occurs, you are covered by Uber's third-party liability policy for up to $1 million.

Does coverage change depending on what the driver is doing at the time of the accident?

Yes, and the distinction matters significantly. If an Uber driver is signed into the app but waiting for a ride request, a lower tier of coverage applies — up to $100,000 per accident for bodily injury, $50,000 per person, and $25,000 for property damage. Once the driver has accepted a ride and is en route to pick up a passenger, or has a passenger in the vehicle, the full $1 million third-party liability coverage applies.

Can I file a claim directly against Uber or Lyft for an accident caused by their driver?

Yes. You can bring a claim against a rideshare company for their driver's negligence, and in many cases that is your primary path to recovering the compensation you deserve.

What if I am an Uber driver who was in an accident while the app was offline?

If you were not active on the app at the time of the accident, your personal auto insurance applies. Depending on the circumstances, you may also have a claim against the other driver or drivers involved.
